TERMS AND CONDITIONS (T&C’s)
(These Terms and Conditions are binding).
GENERAL REQUIREMENTS
The terms & conditions
You must be a minimum of 18 years of age to sell to Devon Gold & by submitting your goods to Devon Gold regardless of whether you have signed & agreed to all of Devon Gold Terms & Conditions or entered your full name & address you are agreeing to all such Terms & Conditions. That you are the legal owner of the items being sent or legally entitled to submit such items and that you are of sound mind and free will when doing so. That they have not been obtained from Illegal activities either in the UK or anywhere else in the world.
Also, by submitting your items you give guarantee that none of the items will place Devon Gold in violation of any laws relating to terrorism, money laundering or any other prohibited laws.
Customers must not submit any materials to Devon Gold that could be deemed as hazardous nor any items that does not contain precious metals.
POSTING AND INSURANCE
Devon Gold requires that all items are sent to us via Royal Mail Special Delivery unless otherwise agreed.
All items are submitted at the owner’s risk until received and signed for by Devon Gold (items are insured by Royal Mail for up to £750 whilst in transit)
Should you believe your items to be worth in excess of this figure you may increase the insurance at the Post Office & pay the difference for the additional fee. If we purchase your items, this fee will be refunded upon sight of the original receipt from the post Office.
If there is no purchase Devon Gold will not be able to refund this extra fee.
You will be required to provide us with the quantity of being sent to us on the form provided, complete all the other details in full and sign the Customer Declaration.
Devon Gold reserve the right not to accept any application & items if the information is incomplete & unsigned.
Devon Gold reserve the right to reject acceptance of delivery of any package that appears to have been opened, damaged or tampered.
Any such packages will be returned to you FOC and without any liability to Devon Gold.
GEMSTONES
Devon Gold does accept gemstones within settings however they do not have any great value. Should there be a significant piece which does have a value we will take this into account when an offer is made to the customer.
VALUATION AND OFFER
Once received your items shall be checked &/or tested by our trained valuation experts to ascertain their value which is primarily based on the current day values. This process may involve placing certain acids on the gold, silver, platinum or other items which can leave permanent staining and/or deep scratches. By submitting your items, you are in acceptance of these terms.
Devon Gold will not be liable for any damage caused in this way or any resulting decrease in the value of the items.
We will contact you by phone to make an offer however should we be unable to reach you we shall continue trying whilst securely holding your goods.
Should we be unsuccessful in contacting you after 28 days we will submit payment of our offer to the address supplied & items held against that payment will be clear for submission to refiners.
Any offer made is valid up until 17.00 hrs of the same day due to ever changing prices.
Once you have given acceptance of our offer the goods may be sent away to refiners and therefore your acceptance is legally binding and irrevocable.
Any items of no value will not be returned unless specifically requested and this may incur a postage & packaging fee.
HOW DO I GET PAID?
Once an offer has been accepted payment details will be discussed and arranged with you. Our payment methods are either via BACs transfer or Cash the latter of which will be issued within 48 hours of acceptance.
If you opt for the cash service, sent securely by Royal Mail Special Delivery there will be a charge to you of £9 for postage fee plus a further £10 charge for each cash transaction up to One Thousand Pound to cover Devon Golds admin and banking fees. Cash limits per Special Delivery postage bag are set at £2,500 and this would therefore incur a £30 admin fee plus £9 postage charge. We will send you the cash in British Bank notes and £1 or £2 coins, with the amount rounded down to the nearest whole pound. The cash will be sent in a secure and insured envelope and will need to be signed for at your address. This service is usually delivered by the following working day and will ONLY be sent to the address where the original pack was sent to.
We may ask for proof that the named person appears on the Electoral Register for that address.
Once you or any other member of your household have received & signed for delivery there will be no recourse or liability to ourselves. Due to this it is strongly suggested that you only use this Cash via post service if all occupants of your address are known to you and trusted.
Alternatively, we can use a Direct bank transfer to your chosen Account where the funds will be paid straight into your account – this service is free of charge.
RETURNED ITEMS
Almost all customers accept the offer we make them however if you reject our offer then your goods will be returned to you at no cost and within 5 working days from date of declined offer. Should you then decide to resend us the same items we cannot guarantee the same offer due to fluctuating prices – if our second offer is refused, we reserve the right to make a charge of £19 toward administration & handling costs.
For any packs received that do not contain any precious metals there will be a £19 handling fee for their return or they can be disposed of FOC.
Payment must be received within 28 days from the day you submitted your package or your items will automatically be disposed of.
UNDELIVERED RETURNED ITEMS or CASH PAYMENTS
If the Royal Mail are unable to deliver or obtain a signature, an instruction card will be left, and packages return to the local delivery office to be collected within a certain period of time. If unclaimed within the time given the item/s will be returned to ourselves. We will then endeavour to make contact to arrange for them to be re-submitted which will incur an administrative charge of £19 to cover all costs.
For returned cash payments to be re-sent, this will be done minus the £19 admin & handling costs.
We reserve the right to purchase any items that have not been reclaimed within a period of 21 days of initial contact less deductions made for current prices and a £20 charge to cover administration, storage & insurance.
LOSS LIABILITIES
In the extremely unlikely situation of goods being lost or misplaced once received by us, we will replace or cover the cost of replacement once proof of items & their value is submitted to us.
Devon Gold will not be liable for any items becoming lost or damaged in transit. If items are lost or damaged Devon Gold will provide all relevant documentation required in order to make a claim from the carrier for the replacement or repair of the lost or damaged items. The customer also agrees to provide all such information as we or the return carriers’ Insurance company may reasonably request in order to successfully process the claim.
UNIDENTIFIABLE PACKS
If our application form has not been correctly completed, we are unlikely to be able to identify the owner unless a name and address is visible on the envelope. It is possible we may be able to trace it back from our website however, if this is not the case the items will be deemed as LOST PROPERTY and will be securely held by us for a period of 6 months. To reclaim said items, the customer will need to provide a full and detailed description before a new offer may be made at current prices subject to a deduction to cover storage, insurance & administration costs.
However, if there has be no claim within 6 months the items will be sent away to be refined to recover our storage and insurance costs of £5 per week.
Any claim made thereafter, payment to owner will be made less any charges.
ITEMS SENT IN ERROR (NOT INTENDED FOR US)
Our Special Delivery envelopes are coded with a unique license and are for customers sending precious metal with the intent to sell.
If using our Special Delivery envelope to send items that are intended for someone else the fee for returning these items is £30, to cover postage, insurance and administration costs.
CLAIMS
A customer who wishes to submit a claim to Devon Gold must notify us immediately to request a claim form. In order to be processed, the claim form must be fully and accurately completed, signed and posted to Devon Gold in accordance with the claim form instructions. The customer must submit any and all supporting documentation with the completed and signed form. Failure to properly complete, sign and post the claim form may result in the denial of the claim.
There is a 14-day processing period from the time the claim form is received by us and the claim processed. Your statutory rights remain unaffected.
All phone calls between Devon Gold and its customers or potential customers may be recorded for security and training purposes. Any such recording may be relied upon by Devon Gold in the event of any dispute.
LEGAL INFORMATION
This Agreement shall be governed by the laws of England and Wales and Devon Gold failure to exercise or enforce any right or provision of these T’s and C’s will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of these T’s and C’s will remain in full force and effect. Customers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Devon Gold must be filed within one (1) year after such claim or cause of action arose. Any such claim or cause of action must be filed in the UK.
You agree to indemnify and hold harmless Devon Gold against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach by you of these T&C’s including claims brought by third parties.
Devon Gold reserves the right to change these T&C’s and advise you to revisit our website, at devongoldjewellers.com, periodically to ensure that you are aware of our current T&C’s If a customer sends items more than once, it is your responsibility to check the T&C’s on each separate occasion that you choose to send us gold or jewellery items to ensure you know our latest T&C’s by which you agree to be bound by sending those subsequent items to us.
Devon Gold complies with all requirements of the Data Protection Act. Your information will only be used if you have given us permission to do so. Any bank account or similar details you provide will be treated confidentially and will only be stored subject to high security methods and only if we have your permission in advance.
Devon Gold is a UK business and only accepts gold from UK addresses and only pays to UK accounts.
